Sulzer Mixpac Files Lawsuit Against Mixing Tips Copiers and Gains Key Judgment

December 12, 2012, Sulzer Mixpac Ltd. (Sulzer) announced today that it has taken further legal actions to protect its products from copying at the 2012 Greater New York Dental Meetings (GNYDM) held at the Javits Center. On November 26, 2012 Sulzer filed a lawsuit in the U.S. District Court for the Southern District of New York alleging that Spident USA Inc., Spident Co. Ltd (Korea) and International Safety Products, Inc. dba iDental infringed Sulzer’s Trademark and Patent rights by offering counterfeit mixing tips.


Also on November 28, 2012, the same court in New York entered a Consent Judgment and Permanent Injunction against UC Dental dba HappyStone. The judgment states that so called new design transparent base mixing tips made by Seil Global of Korea, and distributed by UC Dental are counterfeit and infringe Sulzer’s U.S. Trademark Registrations and Patent, and that certain advertising for the products constitutes false advertising. The Permanent Injunction prohibits further advertising, sale or offer for sale of the Seil Global made mixing tips, or use of the false advertising in the United States.
